Sell ONLY to Law-Abiding Adults
Body Armor is
a purely defensive item but, regardless, we are very sensitive to
the possibility of vests being misused by criminals. By buying a vest
from us, you certify that you are law-abiding, of adult age,
and have no felony convictions. We do not sell to felons or minors.,
It is against
the law for a person convicted of a 'crime of violence' to possess Body
Armor under federal law (unless required by your employer, see,
Sec. 931). It is also illegal under state law for a convicted
felon to own armor in many states.
We cooperate
with law enforcement to stop the use of vests by criminals.
If you
have any criminal purpose in mind (or resell your armor to a criminal)
you do NOT want to have bought Body Armor from us! (The only
loophole in our Privacy Commitment
is to respond to inquires from law enforcement where armor we sold
is suspected to have been involved in a crime.)
We reserve the
right to refuse to sell to anyone, in our sole discretion. By buying
body armor you guarantee that you are not legally prohibited from
owning firearms, or body armor, and also that you are not associated
with any criminal group, in any way, and have only a lawful purpose
for owning body armor.

WARNING:
U.S. EXPORT CONTROL LAWS
Level III and IV
armor (Rifle Plates) fall under the jurisdiction of the International
Traffic in Arms Regulations (ITAR), and is subject to the export control
laws of the U.S. Government. Export
or retransfer of Rifle Plates by any means to any foreign end user,
or for any other end use, whether in the U.S. or abroad, without the
written approval of the U.S.
Department of State, is prohibited.

exemption for a U.S. person taking their personal protection with them

Level III-A,
Level II, and Level II-A VESTS often
have an export license exemption for many countries, but require a
license from the Bureau
of Industry & Security (BIS)
for a few select countries
Kevlar
Helmets in quantity, Ballistic Shields, Riot Shields, Faceshields
and other sensitive items generally require an export license from
the BIS.
Residents
of Connecticut:
Are prohibited
from buying Body Armor unless the sale is face to face (or unless
the buyer is a police officer, Police Department, or military). We
cannot ship to residents of Connecticut who are not police or military.
Residents of Alberta,
British
Columbia, Manitoba:
We will ask you
to provide us documentation of your exemption status, or your Body
Armor license before purchasing.
NO Armor is 100% Bulletproof
A 'bulletproof' vest or
other armor will protect you from the vast majority of pistol ballistic threats
you are ever likely to face. But there is always a tradeoff between more protection
and more wearability (and the constraint to stay within your budget). Please
know that:
- rifle rounds
- unusual high velocity
pistol ammunition
- pistol ammo fired from
a rifle barrel
- armor piercing ammunition
- sharp-edged or pointed
instruments (e.g., knives, icepicks, etc.), and/or
- other unusual ammunition
or situations...
CAN defeat body armor.
Also, at some angles projectiles
can slide, or deflect off the edges of Armor, or ricochet. Furthermore, projectiles
that are successfully stopped by armor will always produce some level of injury,
resulting in severe bruising, broken bones, and possibly serious internal injury
or even death. Soft body armor defeats most pistol and shotgun projectiles,
but NO vest on earth makes you invulnerable to all threats. To
state the obvious, getting shot ALWAYS carries some risk.
Be
aware that your head is much more susceptible to blunt trauma than
your body. ANY impact of a bullet on a helmet WILL CAUSE INJURY AND
CAN CAUSE DEATH. You put the odds more in your favor with head protection,
but, just as with ANY armor, no guarantee of invulnerability can be
made.
By buying Armor you assume
ALL risks of use or misuse, and agree not to hold us liable in any way.
In addition, YOU are responsible to ensure that your ballistic panels are positioned
inner side IN, and outer side OUT if applicable (check the inside vest panel
label).
We Assume NO Liability
Other than our
GUARANTEE of Satisfaction
or Manufacturer Warranty,
as applicable, we neither assume, nor authorize any person to assume
for us any liability in connection with the sale or use of the goods
sold, and there are no oral agreements or warranties collateral to
or affecting this agreement. We hereby give notice that any statement
made by us in the sale of the goods, shall not create any warranty
that the goods shall be fit for any particular purpose. Statements,
images or descriptions are informational only, and not made or given
as a warranty of the goods in any way. We specifically disavow any
other representation, warranty, or liability related to the condition
or use of the goods.
We do not cover
any consequential damages, and our liability is limited to repairing
or replacing defective goods. Pursuant to the provisions of the California
Song-Beverly Consumer Warranty Act, this product is sold "AS IS" and
"WITH ALL FAULTS". The entire risk as to the quality and performance
of the product is with the buyer. We are not an insurer, and bear
no liability for any use, misuse, or failure to perform.
Our GUARANTEE
of Satisfaction or Manufacturer
Warranty as applicable, IS IN LIEU OF ALL WARRANTIES INCLUDING
THE IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY. INCIDENTAL
AND/OR CONSEQUENTIAL DAMAGES ARE EXCLUDED.
Purchaser covenants
and agrees that the purchaser or his heirs, agents, assigns shall
NEVER bring any action in any court of law. Any dispute arising from
the Purchase and Sale of product(s) sold by Bullet Proof ME, shall
be resolved by Arbitration under the Rules of the American
Arbitration Association. Venue for any arbitration, or any legal dispute,
shall lie only in City of Austin, Travis County, Texas and in no other
Venue or Forum. The Laws of the State of Texas shall apply to all
transactions.
If any part of
these Terms are held to be invalid by a court of competent jurisdiction,
such shall not affect the validity of any other part of these Terms.
Headings are for convenience only, and do not limit or affect these
Terms.
Standard Terms:
Customer is responsible
for all sales or use or import taxes, customs processing fees, etc.,
etc.
Returned Checks
Subject to a $30 Fee.
Address Corrections
due to Customer Error will be charged our cost from shipper of $5
to $10.
Any Invoice or
Shipment Unpaid 30 days from date of Delivery is Liable for 1.5% per
month Interest Charges payable from date of delivery.
Any shipment damage
or loss in transit must be communicated to us within 2 business days
from delivery to claim for damage or loss.
